2. Bookings, Deposits, and Payment Terms
To secure our services and commence production, a deposit is required based on the nature of the project:
• Local (South African) Productions: A 50% deposit is required to commence the project (subject to the cancellation terms in Section 3).
• International Productions (outside of SA): A 75% deposit is required to commence the project (subject to the cancellation terms in Section 3).
• Post-Production Milestone: An additional 20% of the total project fee is due immediately after the shoot is completed.
• Final Delivery: The remaining balance is payable within 7 days of the final invoice date. Final high-resolution files will not be released until final payment is cleared. Invoices unpaid past the due date will accrue interest at a rate of 2% per month. The client shall be liable for all legal and collection fees incurred by A1 Studios in recovering outstanding balances.
3. Cancellation and Refund Policy
Shoot dates are reserved for you once your deposit is paid, and we turn down other work for those days.
• Within seven days of booking: If you cancel within seven days of accepting your quote, and before we have started any work for you, we refund your deposit in full.
• More than 14 days before the shoot: You can move your shoot once, to a date within six months, at no charge. If you cancel instead, we refund your deposit less any costs we have already paid or committed to for your shoot and cannot recover, such as crew bookings, travel, accommodation and permits.
• 14 days or less before the shoot: At this point, we are unlikely to secure replacement work, so a reasonable cancellation penalty will apply. We will retain a portion of the deposit commensurate with our actual financial losses, administrative time, and unrecoverable third-party expenses, up to the full value of the deposit.
• After the shoot: If you terminate the project during post-production, you will be billed pro-rata at our standard hourly editing rate for all time logged up to the cancellation notice. Upon settlement of this final invoice, we will hand over the unfinished materials 'as-is', with no further warranties or revisions provided.
• Weather and wildlife: If weather makes a planned shoot day impossible, we move it to a new date with you. That is never treated as a cancellation and no cancellation charge applies.
• If we have to cancel: If we cancel for any reason other than weather, you choose between a new date and a full refund of everything you have paid.
• Illness and bereavement: In accordance with Section 17 of the Consumer Protection Act, no cancellation fee will be charged if the cancellation is demonstrably due to the sudden death or hospitalization of the specific individual for whom the booking was made. Please note this statutory exception applies primarily to individual consumers, not to corporate entities cancelling commercial shoots due to staff illness.
• How to cancel: Please cancel or move a booking in writing to info@a1studios.org. The date we receive your email is the date we use. Refunds are paid by bank transfer to the account you paid from, within ten working days of the cancellation being confirmed. Nothing in this policy limits any right you have under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.
4. Revisions and Post-Production
• Included Revisions: Our standard project scope includes two (2) rounds of client revisions on the final edit.
• Additional Revisions: Any further revisions requested beyond the initial two rounds will be billed at an hourly post-production rate. A quote for these additional revisions, based on editing complexity, will be provided to the client and must be approved in writing before any further post-production work commences.
5. Deliverables and Quality Assurance
• If something we deliver is not right: If an objective technical fault or deviation from the agreed-upon brief cannot be remedied, A1 Studios may, at its sole discretion, offer a pro-rata refund strictly limited to the specific portion of the deliverables affected. We do not offer refunds based on subjective creative differences once the agreed-upon brief has been fulfilled.
6. Intellectual Property and Raw Footage
• Ownership: A1 Studios retains full ownership of all raw footage, project files, timelines, and working assets created during the production process.
• Licensing: Upon final cleared payment, the client is granted a perpetual, non-exclusive, non-transferable, worldwide license to use, distribute, and broadcast the final rendered video deliverables strictly for the platforms and purposes explicitly agreed upon in the project brief. Any use beyond the original scope requires a separate licensing agreement.
• Exclusivity of Raw Files: Raw footage and project files are strictly excluded from client deliverables unless explicitly negotiated, priced as a buyout, and stipulated in a separate contract.
7. Liability and Indemnity
A1 Studios applies a research-informed, data-led approach to production to ensure the highest quality results. However, we are not liable for incidental, indirect, or consequential damages arising from the use of our video products. In no event shall A1 Studios' total aggregate liability for any direct damages, claims, or losses arising out of a project exceed the total fees actually paid by the client for that specific project. Furthermore, while A1 Studios utilises a research-informed, data-led approach designed to maximise audience engagement, we do not promise or guarantee specific business outcomes, financial gains, ROI, or increases in sales/bookings. Any metrics or projections discussed prior to production are estimates only, and final market performance remains entirely outside of our control. Unless explicitly quoted and agreed upon in writing, clients are solely responsible for securing all necessary brand assets and location permits. A1 Studios will manage and secure talent release forms for all professional on-screen talent hired by our agency. However, if the client supplies their own staff, customers, or guests to appear on-camera, the client bears full legal responsibility for securing their written consent and indemnifies A1 Studios against any resulting claims.
